First and foremost, STAY CALM! And YES, you can stop all those calls by filing bankruptcy in Canada!

Collection agencies rules: how can you stop collection calls?
There are obviously rules that dictate what debt collectors can and can't do:

  • Collection agencies may not harass you or your family. Calling you once or twice a day is acceptable; however, more aggressive and frequent calling per day can be considered harassment.
  • Collection agencies may not call you on a statutory holiday, on a Sunday before 1 pm or after 5 pm, or on any day before 7 am or after 9 p.m.
  • Collection agencies may not contact you (by phone, voicemail, or e-mail) more than three times in any one week period on behalf of the same debt or creditor.
  • Collection agencies may not contact your friends, relatives, neighbors or employers for any information other than your address or telephone number unless in a case where someone is a co-signer for the said loan or credit.

***Keeping a record of the time, date and frequency of the calls will be necessary to make a formal complaint if this type of activity persists. 482964phone

The companies that you owe money to, your "creditors", have a right to contact you in hopes of retrieving their money. They will keep trying to call until they speak to you, so avoiding them will not help the situation. They will likely reduce their calls if an honest timeframe is given in order for you to assess your financial capabilities. You should treat the caller in a professional manner and be honest about the chances of any payment being made, if you don’t deliver on your promises, they will only become more aggressive in their collection attempts. Each of our licensed Druker and Associates Bankruptcy Trustees can provide an initial consultation. It is always confidential and always free of charge. They will analyze your situation; advise you on how to stop the collection calls, and explain which financial solutions are best suited to you.
